Can I amend a signed rental contract?

It is not possible to modify or make changes to a signed rental contract on BoligPortal, as it (if signed by all parties) is a legally binding contract between the landlord and the tenant(s).

If you need to make changes to or extend a rental contract you can either create a new contract or draft an addendum — also known as an allonge — to the existing contract.

At BoligPortal, we unfortunately do not have a built-in tool for drafting addendums. If you want to keep your documents organized on BoligPortal, you will need to create a new lease agreement that includes the desired changes, which must then be signed again by all parties.


How to modify or extend a rental contract with a new contract

To modify a rental contract or, for example, extend the rental period of a fixed-term lease, you must create a new lease agreement that replaces the old one.

In the new contract, it is very important to clearly state which contract is valid. This should include a clear description of why the original contract is being canceled and replaced by the new one. You can add this information under Section 11.

The new, updated contract must be signed again by all parties to be legally valid.

If all parties have not yet signed, you are free to make changes

Remember, you can easily edit or make changes to BoligPortal's digital rental contracts as long as at least one party has not signed it yet.

This means you can make corrections to the contract if, for example, you notice an error shortly after sending the signature request.

Simply cancel the request, make your changes, and resend the rental contract for signing.

How to cancel your rental contract signature request

  1. Go to the 'Rental Contracts' section on your profile and select the 'Afventer underskrift' (Pending Signature) tab.

  2. Find the desired rental contract and click on ' til oversigt' (Go to Overview).

  3. Click the 'Annuller anmodning' (Cancel Request) button and then confirm the cancellation.

  4. The rental contract will now be moved to the 'Kladder' (Drafts) tab, where you can find it and click on 'Udfyld' (Fill Out) to make your changes.

Once you have edited the contract draft, just remember to send it for signature.

Be aware that the tenant will receive direct notifications via email and SMS when you cancel a rental contract. Therefore, it is a good idea to inform your tenant that you are canceling the signature request to make changes to the contract, and that they will receive a new contract to sign.

 

There is an error in my rental contract. What should I do?

If you notice an error in an already signed rental contract, it is important to get it corrected to avoid misunderstandings or issues later in the tenancy.

You can either correct the error in the rental contract by creating a new one that all parties sign again, or by creating an addendum in the form of an allonge, where the error is described and corrected.

Make sure the corrected version of the rental contract is signed by all parties – that is, by the landlord and all tenants – so it is legally valid.

Can I transfer a rental contract to someone else?

If you wish to transfer a rental contract, it is usually a good idea to create a new rental contract, which must be signed again by both the landlord and the person taking over the lease.

It is also possible to create an addendum – an allonge – to the existing rental contract, stating that the lease is transferred to a new tenant. This addendum must be signed by all parties to be legally valid.

If you are using BoligPortal’s digital rental contract builder, you can simply copy the original rental contract directly in the system and send it for signature to your new tenant.

Can I add a name or tenant to a rental contract?

If you wish to add a name to a signed rental contract, for example, if your tenant's partner is moving into the property, you must either create a new rental contract and add the person to the contract or create an addendum where they are added as a co-tenant.
