How to Customize BoligPortal's Standard Terms and Add Your Own § 11 Terms
When using BoligPortal's standard terms for your § 11 section, it is important to carefully review all clauses to ensure they fit your specific rental property and agreement.
You can also add additional standard terms or include your own individual terms if needed.
Edit and Customize Standard Terms
- Go to the 'Særlige vilkår (§ 11)' section in the rental contract builder
- Click on the three vertical dots next to the term you wish to customize
- Customize the term in the text field and finish by clicking on 'Gem'
Note: It is a good idea to only adjust the parts of the term that specifically pertain to your rental property. When you modify a standard term, it is important to ensure that the changes still comply with Danish rental law and do not violate legally mandatory provisions.
If you modify a term in a way that contradicts the rental law or conflicts with other clauses in the contract, you risk your § 11 term being invalid. We recommend seeking legal advice if you are uncertain about the legality of any changes to a term.
Add Standard Terms
- Go to the 'Særlige vilkår (§ 11)' section in the rental contract builder
- Click on '+ Tilføj standardvilkår'
- Check the relevant standard terms and click on 'Tilføj vilkår' to include them in the rental contract
- Read through the term and modify it to suit your rental agreement
Add Your Own § 11 Term to the List of Standard Terms
- Go to the 'Særlige vilkår (§ 11)' section in the rental contract builder
- Click on '+ Tilføj eget vilkår'
- Fill in the term with a title and text
Note: When writing your own § 11 terms from scratch, you must ensure that they comply with mandatory regulations in the danish rental law. They should also be written clearly, accurately, and unambiguously, without being considered unfair according to the contract law.
If your term is written in a way that is vague or unclear, leading to potential interpretation issues, or if it directly contradicts the rental law, you risk it being declared invalid in case of disputes between you and the tenant.
If you're uncertain, it might be a good idea to solely use BoligPortal's standard terms or have your own terms reviewed by a lawyer or another legal professional for quality assurance.
How to Add Your Own § 11 Section to Your Rental Contract
If you do not wish to use BoligPortal's standard terms, you can add your own § 11 section. You will add it as a PDF file, which will then be attached to the completed rental contract as an annex. Under the § 11 section of the contract, there will be a reference to this annex.
Be aware that if you add your own § 11 section, all other § 11 terms available under the 'Brug BoligPortals § 11' tab will be deactivated.
Therefore, you can only use one of the two tabs.
- Go to the 'Særlige vilkår (§ 11)' section in the rental contract builder
- Click on 'Benyt egen § 11'
- Click on 'Gennemse' or drag and drop your PDF file to add your § 11 terms
Your PDF with your § 11 terms will now automatically be added as an attachment to the completed rental contract.
The fact that your § 11 section now appears as an attachment does not affect the validity of the terms or the rental contract, as the contract will correctly reference the attachment.
